Terms of Service

1. Agreement to Terms

By accessing or using MileAway (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the App.

2. Description of Service

MileAway is a travel tracking application that automatically detects and logs the countries you visit. The App provides features including:

  • Automatic country detection and travel logging
  • Interactive world map visualization of visited countries
  • Achievement system for travel milestones
  • Social features including leaderboards and friend connections
  • Travel history and statistics

3. User Accounts

To use certain features of the App, you must create an account. You agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

4. Location Data and Privacy

MileAway requires location access to function properly. By using the App, you consent to:

  • Collection of your device's location data when you travel
  • Processing of location data to determine countries visited
  • Storage of travel history and statistics
  • Sharing of anonymized travel statistics for social features

5. User Conduct

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to circumvent location detection systems
  • Share false or misleading travel information
  • Harass or abuse other users through social features
  • Reverse engineer or attempt to extract the App's source code
  • Use automated systems to manipulate your travel data

6. Accuracy of Travel Data

While we strive for accuracy, MileAway's automatic location detection may not be perfect. We are not responsible for any inaccuracies in travel data, missed countries, or incorrect location logging. The App is designed for entertainment and personal tracking purposes.

7. Social Features

When using social features (leaderboards, friend connections, profile sharing), you agree that:

  • Your travel statistics may be visible to other users
  • You may receive friend requests and social interactions
  • We may display your achievements and travel milestones
  • You can control your privacy settings within the App

8. Intellectual Property

The App and its content, features, and functionality are owned by MileAway and are protected by international copyright, trademark, and other intellectual property laws.

9. Termination

We may terminate or suspend your account and access to the App at our sole discretion, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

10. Disclaimer of Warranties

The App is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the App's reliability, accuracy, or availability.

11. Limitation of Liability

In no event shall MileAway be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data, or business interruption.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes through the App or by email. Continued use of the App after changes constitutes acceptance of the new Terms.

13. App Store Subscriptions and In-App Purchases

If you purchase a subscription or make in-app purchases through the Apple App Store, the following terms apply:

  • Payment: Payment will be charged to your iTunes Account at confirmation of purchase.
  • Auto-Renewal: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Renewal Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period, and the cost of the renewal will be identified.
  • Managing Subscriptions: You can manage your subscriptions and turn off auto-renewal by going to your Account Settings after purchase.
  • Cancellation: No cancellation of the current subscription is allowed during the active subscription period.
  • Free Trial: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription to that publication.
  • Apple Terms: Your use of the App is also subject to Apple's Terms of Service and Apple Media Services Terms and Conditions.

14. Refunds and Cancellations

For purchases made through the Apple App Store:

  • All sales are final and non-refundable except as required by applicable law.
  • Refund requests must be made directly to Apple through the App Store, not to MileAway.
  • Apple's refund policy applies to all App Store purchases.
  • You may cancel your subscription at any time through your Apple ID account settings.

15. Apple End User License Agreement

This App is licensed, not sold, to you by MileAway for use strictly in accordance with the terms of this license. The following additional terms apply when you download the App from the Apple App Store:

  • License Scope: The license granted is limited to a non-transferable license to use the App on any Apple device that you own or control.
  • Maintenance and Support: MileAway is solely responsible for providing maintenance and support services with respect to the App.
  • Warranty: In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you.
  • Product Claims: MileAway, not Apple, is responsible for addressing any claims relating to the App or your possession and/or use of the App.
  • Intellectual Property: In the event of any third-party claim that the App infringes that third party's intellectual property rights, MileAway will be solely responsible for the investigation and resolution of such claim.
  • Legal Compliance: You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or designated as a "terrorist supporting" country.
  • Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance of these terms, Apple will have the right to enforce this EULA against you.
